The only way for conflicted spouses to know if they are in a sacramental marriage, or not, is for them to apply for a Church annulment. However the Church will not open an annulment case unless the couple has already obtained a civil divorce. In other words the Church is actually forcing couples to first get a civil divorce before they can get a Church judgment as to whether it is morally legitimate for them to get a civil divorce.
Applying for separation is different than applying for an annulment. There are individuals who believe their marriages to be valid and do not desire an annulment, but simply desire the Church's approval to separate. The frustrating thing about the immigration issue is this - the Church has the right teaching to address both communities if it actually applied what it teaches. I work in a migrant hotel and just before I left I was having a discussion and one of the people who is here on behalf of the Government is Eastern European but even she was supportive of Ordo Amoris when I explained how it showed that this situation was wrong and shouldn’t be happening. The Church wants to heal the world and it has the solutions and the answers in the teachings of the Gospels and its own deposit of faith. This is why I bang on about the class problem we have with the Clergy - too much time in the Seminary and not enough time in the Seminary of Life im afraid, they shill for globalists because they are globalists. PS all expenses paid tea and sympathy tours of Peru are not real life - it should be mandatory for all Clergy to spend at least one to two years working with the poor of their own Dioceses, not some foreign jolly day, where they were born and raised even if then moved away (less if they are second life).
